Patna High Court

Lalan ManjhiversusThe State of Bihar

The court granted provisional anticipatory bail subject to a bail bond, sureties and verification of antecedents.

Summary

The petitioner, Lalan Manjhi, feared arrest in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act for alleged recovery of 45 litres of liquor each from a house behind Rajendra’s residence and from his own house, which is a joint‑family property. He contended that no liquor was found in his conscious possession, that the 2018 amendment to the Excise Act had done away with the concept of deemed possession, and that the allegation originated from a hostile watchman. The State opposed his application for anticipatory bail. The Patna High Court, after hearing both sides, ordered provisional anticipatory bail on the condition of a Rs 10,000 bail bond and two sureties, subject to verification of his criminal antecedents under Section 482(2) of the B.N.S.S. The order further provided that if more than two prior cases are discovered, the bail would not be confirmed; otherwise it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act given the alleged facts and the petitioner’s antecedents.
  • Whether the removal of the concept of deemed possession by the 2018 amendment affects the grant of anticipatory bail.
