DISPOSED

Holding

The Court provisionally granted anticipatory bail to the petitioner, subject to bail bond, sureties, and verification of his criminal antecedent.

Summary

The petitioner, Jani Mahto, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged recovery of 60 litres of liquor. He argued that the liquor was seized from a location not under his possession and that the investigation was mechanically driven without proper inquiry. The State opposed the bail, contending the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties, subject to verification of the petitioner’s criminal antecedent. If more than two prior cases are found, the bail will not be confirmed; if only two, it will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail under Section 438 of the Cr.P.C. is warranted in a case under Section 30(a) of the Bihar Prohibition and Excise Act
  • Whether the petitioner’s alleged lack of possession of the seized liquor negates the basis for arrest
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail

petitioner was not arrested from the spot, as such, nothing was
