Holding

The Court granted provisional anticipatory bail to the petitioner, subject to bail bond, sureties, and verification of his criminal antecedent.

Summary

The petitioner, Rakesh Kumar, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 21.75 litres of liquor from a motorcycle. He contended that he was not the owner of the vehicle, that the liquor was not seized from his conscious possession, and that his implication rested solely on confessional statements of co‑accused Arjun and Pawan made in police custody, which he argued lack evidentiary value. The State opposed his prayer for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 5,000 with two sureties and a condition that the trial court verify his criminal antecedent within six weeks. The order further stipulated that if more than one prior case is found, the provisional bail would not be confirmed, whereas confirmation would follow if only one antecedent case is discovered.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
  • Whether confessional statements made by co‑accused in police custody constitute sufficient basis for arrest.
  • Whether the petitioner’s alleged lack of ownership of the seized vehicle affects bail considerations.
