Provisional anticipatory bail was granted subject to bail bond, sureties, and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Anil Ray, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging recovery of 133,500 litres of liquor from the house of the deceased Harihar Paswan. He contended that he was not present at the scene, had no possession of the liquor, and had no relationship with the deceased, arguing that the case was based solely on secret information. The State opposed his prayer for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and a condition that the trial court verify his criminal antecedent. The order further stipulated that if more than one prior case is found, the bail would be presumed concealed and not confirmed; otherwise, it would be confirmed. The petitioner was also directed to deposit Rs.2,500 with the Advocates’ Association within two weeks.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Excise Act where the petitioner claims no possession or involvement.
  • Whether the High Court can impose conditions, including verification of criminal antecedent, on a provisional anticipatory bail order.
  • Whether the presence of multiple prior cases would lead to a presumption of concealment and affect confirmation of bail.
