The Court granted provisional anticipatory bail subject to verification of the petitioner’s antecedent and compliance with the stipulated conditions.

Summary

The petitioner, Sanoj Sahani, sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 200 litres of liquor from two motorcycles. He asserted that he had no prior criminal record, was not in possession of the liquor, and was not the owner of the vehicles, claiming the complaint was motivated by personal enmity with a chowkidar. The State opposed the bail application. The High Court, considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs. 500 with two sureties and required the petitioner to deposit Rs. 1,500 with the Advocates’ Association. The order also stipulated that the trial court must verify the petitioner’s antecedent; if any prior case is found, the bail would not be confirmed, otherwise it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the alleged offence under Section 30(a) of the Bihar Excise Act
  • Whether the conditions imposed under Section 482(2) of the BNSS are appropriate for provisional anticipatory bail
