KHURSHID MANSOORI @ KHURSHEED MANSUREEversusTHE STATE OF BIHAR

Decided

DISPOSED

Holding

The court granted bail to the petitioner.

Summary

The petitioner, Khurshid Mansoori, was arrested in connection with a case alleging defalcation of Rs.5,89,342 from Rs.12 lakh received for the Jal Nal Yojna, charged under Sections 409 and 420 of the IPC. He contended that the cheque was jointly signed with co‑accused Salma Bibi and that the entire amount had been paid to various contractors, as evidenced by a letter from the Block Development Officer. The petitioner also highlighted that Salma Bibi had already been granted regular bail and that a recovery proceeding under a certificate case was pending before the District Magistrate. The court noted the prima facie nature of the measurement‑book issues and, considering the petitioner’s clean antecedent, ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 438(2) CrPC and Section 482(2) BNSS.

Issues considered

  • Whether bail should be granted to the accused in a case of alleged criminal breach of trust and cheating under Sections 409 and 420 IPC.
  • Whether the joint signatory claim and payment to multiple contractors create sufficient doubt to merit bail.
  • Impact of pending recovery proceedings on the bail application.
