The court allowed anticipatory bail to Suman Kumari, subject to bail‑bond and surety conditions under Section 482(2) of the B.N.S.
Summary
The petition sought anticipatory bail for two respondents, Amarjeet Singh and his daughter Suman Kumari, in a case involving multiple offences under the B.N.S. Amarjeet's anticipatory bail application was withdrawn after his arrest, and the petition was dismissed with respect to him. Suman, a 20‑year‑old woman with a clean record, claimed she was falsely implicated by her uncle, the informant, in a family property dispute that led to mutual assaults. The State opposed the bail, but the court considered her clean antecedents and the alleged false implication. The court directed that if she is arrested or surrenders within six weeks, she be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S. The anticipatory bail application was therefore allowed.
Issues considered
- Whether anticipatory bail should be granted to Suman Kumari in view of the allegations and her clean antecedents
- Whether the petitioner’s claim of false implication and family dispute warrants bail
- Whether the conditions under Section 482(2) of the B.N.S. are satisfied
