Holding

The court held that an inadvertent typographical mistake in a judgment may be corrected, and the criminal appeal is restored to its original file.

Summary

The petitioners filed a restoration application seeking correction of a typographical error in Paragraph 4 of an order dated 30-01-2026, where the case number was incorrectly printed as ‘Cr. Misc. No. 4713/2024’ instead of ‘Cr. Appeal (SJ) No. 4713 of 2024’. The court examined whether such an inadvertent mistake could be rectified without prejudice to the parties. It held that the error was purely clerical and could be corrected to reflect the true intent of the order. Consequently, the erroneous reference was deleted and the correct case number inserted, thereby restoring the criminal appeal to its original file. The remainder of the original order was left unchanged.
