Patna High Court

Arjun KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail must be granted to the petitioner under the circumstances.

Summary

Arjun Kumar was arrested in connection with a case alleging possession of 115 litres of illicit country‑made liquor recovered from a motorcycle, under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he was falsely implicated, that no incriminating article was found in his conscious possession, and that he had no link to the vehicle. He had been in custody since 24 October 2025 and possessed two prior criminal antecedents, while the prosecution failed to comply with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail, but the court, noting the lack of direct evidence, the procedural lapse, and the length of custody, decided to grant bail. Bail was ordered on a bond of Rs 15,000 with two sureties, subject to conditions of family surety and regular appearance in court.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged possession of illicit liquor and his prior criminal antecedents.
