Holding
The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.
Summary
The petitioner, Dashrath Rai, feared arrest in a case registered under Sections 30(a), 32(ii) and 41(i) of the Bihar Prohibition and Excise Act (Amendment) 2022, alleging that 2,162.88 litres of liquor were recovered from a truck. He contended that he was not in possession of the liquor, was not the owner of the vehicle, and had been implicated solely on the basis of secret information without a proper investigation. The State opposed his application for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.40,000 with two sureties and that the trial court verify his criminal antecedent. The order stipulated that if the verification shows more than eight prior cases, the bail would not be confirmed; if only eight cases are found, the bail would be confirmed forthwith. The decision was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. given the alleged offences under the Bihar Prohibition and Excise Act
- Whether the petitioner’s criminal antecedent warrants denial of anticipatory bail
- Whether the circumstances of the seizure justify a provisional bail order pending verification
