Patna High Court

Jitendra YadavversusThe State of Bihar

The Court ordered provisional anticipatory bail with bond and sureties, subject to verification of the petitioner’s antecedent, confirming bail if the antecedent is limited to seven cases.

Summary

The petitioner, Jitendra Yadav, sought anticipatory bail under Section 438 of the Cr.P.C. after being implicated in offences under Sections 30(a), 38(1) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022, involving alleged recovery of liquor and fake fertilizer. He argued that he was not arrested on the spot, no liquor was found in his conscious possession, and that the police mechanically implicated him without proper investigation. The State opposed the bail, citing his criminal antecedent of seven prior cases, six of which relate to the Excise Act. The Court granted provisional anticipatory bail conditioned on a bail bond of Rs.35,000 with two sureties and directed the trial court to verify the petitioner’s antecedent; if more than seven cases are found, the bail will not be confirmed, otherwise it will be confirmed. The order is subject to the conditions laid down under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 Cr.P.C. despite a substantial criminal antecedent.
  • Whether the alleged seizure of liquor and fake fertilizer justifies denial of anticipatory bail.
  • Whether the trial court may condition confirmation of anticipatory bail on verification of the petitioner’s criminal antecedent.
