The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s antecedent, with confirmation contingent on a clean record.
Summary
The petitioner, Phulbabu Yadav, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 342 litres of liquor from three vehicles. He contended that he was not arrested at the spot, had no conscious possession of the liquor, was not the owner of the seized vehicles, and possessed a clean antecedent. The State opposed his application for anticipatory bail. The Court, after hearing both sides, granted provisional anticipatory bail on the condition of a Rs.500 bond with two sureties and compliance with the conditions of Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S., pending verification of his antecedent. The order further stipulated that if any prior criminal case is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
- Whether the petitioner’s claim of clean antecedent and lack of conscious possession justifies the grant of anticipatory bail.
- Whether the Court may condition anticipatory bail on verification of the petitioner’s criminal antecedent.

ORAL ORDER
2 10-07-2026 1. Heard learned counsel for the petitioner and learned
A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered
for the offence punishable under Section 30(a) of the Bihar
Prohibition and Excise Act.
3. Learned counsel for the petitioner submits that
petitioner is a person with clean antecedent and allegation is of
recovery of 342 litres of liquor from three vehilces.
4. Learned counsel for the petitioner submits that
petitioner was not arrested from the spot, as such, nothing was
recovered from his conscious possession. It is further submitted that
petitioner is not the owner of any of the seized vehicles and came to
be implicated based on the secret information which is the easiest
way to implicate someone without holding a proper investigation of
