The Court granted provisional anticipatory bail with conditions, subject to verification of the petitioner’s antecedent cases.

Summary

The petitioner, Shatrudhan Yadav, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 140 litres of liquor from a motorcycle. He argued that he was not arrested on the spot, had no conscious possession of the liquor, and was not the owner of the vehicle, contending that the investigation relied on secret information without proper inquiry. The State opposed the bail. The Court, considering these submissions, granted provisional anticipatory bail subject to a bond of Rs.20,000 with two sureties, and conditioned the order on verification of the petitioner’s criminal antecedents within six weeks. If the petitioner is found to have more than four prior cases, the bail will not be confirmed; if only four, it will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the petitioner’s antecedent criminal record warrants denial of anticipatory bail.
