BAIL GRANTED

Holding

The Court granted bail to the petitioner.

Summary

Arun Ravidas was arrested in Chanan police station case No. 150 of 2025 for allegedly possessing 65 litres of liquor, an offence under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he was falsely implicated, that no incriminating material was found in his possession, and that the liquor was recovered from a public place. He also highlighted that the investigation had not complied with Section 103 of the Bihar Narcotic Substances (Suppression) Act, 2023, and that he had been in custody since 21‑11‑2025 with only one prior criminal antecedent. The State opposed bail, but the Court, considering the lack of direct evidence, the circumstances of recovery, and the period of detention, decided to grant bail. The petitioner was ordered to furnish a bail bond of Rs.15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition and Excise Act given the facts of the recovery and the petitioner’s prior antecedent.
  • Whether the non‑compliance of Section 103 of the Bihar Narcotic Substances (Suppression) Act, 2023, affects the grant of bail.
