The Court provisionally granted anticipatory bail, subject to verification of the petitioner’s antecedent and compliance with the conditions imposed.
Summary
Suraj Yadav applied for anticipatory bail after the police registered a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 alleging recovery of 159.75 litres of liquor from seven vehicles. The petitioner argued that he was not arrested at the spot, had no possession of the liquor, and was not the owner of the seized vehicles, claiming the case was based on secret information without proper investigation. The State opposed the bail, citing the petitioner’s prior two excise cases. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.10,000 with two sureties, subject to verification of the petitioner’s criminal antecedent. It directed that if more than two prior cases are found, the bail would not be confirmed; if only two are found, the provisional order would be confirmed. The order was made under Section 438(2) of the Criminal Procedure Code and Section 482(2) of the B.N.S.S.
Issues considered
- What is the appropriateness of granting anticipatory bail under Section 438 Cr.P.C. in a case involving alleged excise offences?
- Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
