The court granted bail to the petitioner.
Summary
Pintu Kumar was arrested in a cyber‑related case (Nawada Cyber P.S. Case No. 142 of 2025) on charges under several sections of the Bharatiya Nyaya Sanhita, 2023 and the Information Technology Act. The prosecution alleged that mobile phones and a motorcycle recovered from him contained data pertaining to financial and identity documents. The petitioner contended that he was innocent, that the material was not in his conscious possession, and that his arrest was based merely on suspicion without any incriminating evidence, also noting his lack of prior criminal record. The State opposed bail, while the court considered the length of custody and the nature of the evidence. The court, finding the allegations vague and the petitioner’s custody period extensive, granted bail on condition of a cash bond and two sureties. The petitioner was ordered to be released upon furnishing the bail terms.
Issues considered
- Whether bail should be granted to the petitioner despite the serious charges under the Bharatiya Nyaya Sanhita and the IT Act.
- Whether the evidence recovered justifies continued detention or merely a suspicion sufficient for bail.
