Patna High Court

Hari SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court inclined to grant bail to the petitioner, subject to specified conditions.

Summary

Hari Sah was arrested in connection with a case alleging rape under Sections 498‑A, 376/34 of the Indian Penal Code and Section 8 of the POCSO Act. He contended that he was falsely implicated, asserting that the alleged victim had a consensual relationship with another accused, Bittu Kumar, and that the alleged incident occurred in 2023 with no FIR filed then. The petitioner, who has been in custody since 19‑04‑2025 and has no prior criminal record, sought bail, while the State opposed the relief. The Court examined the seriousness of the charges, the period of custody, and the petitioner’s claim of false implication, and decided to grant bail subject to strict conditions. Accordingly, bail was ordered on a bond of Rs 15,000 with two sureties and conditions regarding appearance, non‑tampering with evidence, and non‑intimidation of witnesses.

Issues considered

  • Whether bail should be granted to the accused in a rape and POCSO case despite the seriousness of the offences.
  • Whether the petitioner’s claim of false implication and lack of prior criminal antecedent justify bail.
