Decided

BAIL GRANTED

Holding

Bail is granted to the petitioner.

Summary

Krishna Kumar was arrested in connection with a case alleging that 270 litres of illicit foreign liquor were recovered from a car, invoking Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner argued that he was falsely implicated, had no incriminating article in his possession, no prior criminal record, and that the prosecution had not complied with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail. Considering the lack of direct evidence, the petitioner’s clean record, and the procedural lapse, the Court decided to grant bail. The bail was set at a bond of Rs. 15,000 with two sureties of the same amount. The order was pronounced by Justice Rudra Prakash Mishra.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the facts of the case
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, warrants bail
