Patna High Court

Sonu KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied.

Summary

The petitioner, Sonu Kumar, sought anticipatory bail fearing arrest in a case under Sections 30(a) and 32(ii) of the Bihar Prohibition and Excise Act, where 919.05 litres of liquor were seized from a pick‑up van. He contended that he was neither the owner nor the driver of the vehicle and that he had been falsely implicated, also noting the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail, highlighting the petitioner’s two prior criminal antecedents of a similar nature. The Court, considering the seriousness of the alleged offence and the petitioner’s criminal record, declined to grant anticipatory bail. However, the Court directed that if the petitioner surrenders within six weeks and applies for regular bail, the application will be considered on its merits.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Sections 30(a) and 32(ii) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail.
  • Whether non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, affects the bail application.
