Holding
The Court granted provisional anticipatory bail to the petitioner, subject to specified conditions and verification of her criminal antecedent.
Summary
Ranju Devi applied for anticipatory bail after learning that she might be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 20 litres of liquor and 300 litres of Jawa Mahua solution from her residence. She contended that she was not arrested on the spot, that the liquor was not in her conscious possession, and that the house is a joint‑family property, making it uncertain whether she kept the liquor. The petitioner further argued that the concept of deemed possession was removed by the 2018 amendment to the Excise Act and that the allegation stemmed from a false complaint by a watchman hostile to her husband. The State opposed the anticipatory bail, citing the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail subject to a Rs.5,000 bail bond with two sureties, a deposit of Rs.1,500 to the High Court Legal Services Committee, and a condition that the trial court verify her criminal antecedent. If more than one antecedent case is found, the provisional bail will not be confirmed; otherwise it will be confirmed forthwith.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. in view of the alleged possession of liquor and her criminal antecedent.
- Whether the amendment removing the concept of deemed possession affects the bail application.
