Decided

BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to a bond, sureties and conditions under Section 438(2) CrPC and Section 482(2) B.N.S.S.

Summary

Kundan Kumar, the petitioner, was named in an FIR for alleged cruelty and dowry-related offences under several sections of the Indian Penal Code and the Dowry Prohibition Act. He applied for anticipatory bail, claiming that his wife, Gitanjali Devi, had deserted him, never joined his matrimonial home, and subsequently remarried and had a child. The petitioner’s counsel supported these claims with an affidavit. The opposite party did not appear despite notice. The State opposed the bail, asserting that the petitioner was the husband facing cruelty charges. Considering the affidavit and the non‑appearance of the wife, the court granted anticipatory bail subject to a bond and sureties, invoking Section 438(2) of the CrPC and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC in view of the allegations of cruelty and dowry demands.
  • Whether the affidavit alleging the wife’s desertion and second marriage is sufficient to justify bail.
  • Whether the provisions of Section 482 of the Bharatiya Nagarik Suraksha Sanhita apply to the grant of anticipatory bail.
