Holding

Anticipatory bail is granted to the petitioner subject to the conditions specified.

Summary

The petitioner, Uday Singh, sought anticipatory bail fearing arrest in a case (Hisua P.S. Case No.198 of 2025) for alleged involvement in the killing of the informant's sister, an offence alleged under sections 80/3(5) of the B.N.S., 2023. The FIR indicated that the deceased was taken to a hospital where she died, and her husband is already in custody, while their children reside with the petitioner. The court examined the petitioner's apprehension of arrest and the nature of the allegations. Considering the circumstances, the court granted anticipatory bail, directing the petitioner to surrender within six weeks and to furnish a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the B.N.S. The order also stipulated compliance with the Chief Judicial Magistrate, Nawada.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the allegations of offences under sections 80/3(5) of the B.N.S., 2023
  • Whether the conditions prescribed under Section 438(2) of the CrPC and Section 482 of the B.N.S. are sufficient for granting anticipatory bail
