Patna High Court

Anubhav Singh @ Bholu Singh @ AbhinavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Anubhav Singh, sought bail in a case (Brahmpur P.S. Case No. 205/2025) for alleged offences under Section 30(a) of the Bihar Prohibition and Excise Act, where 419.6 litres of liquor were recovered from a vehicle. The petitioner argued that he was falsely implicated, that no incriminating article was found in his possession, and that his name was linked to the case only through a chowkidar’s disclosure, with no connection to the vehicle. He had been in custody since 12‑12‑2025 and possessed one prior criminal antecedent, and the prosecution had not complied with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed bail. Considering the lack of direct evidence, the duration of custody, and the statutory non‑compliance, the Court granted bail, ordering a bond of Rs.15,000 with two sureties of equal amount.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act given the facts of the case
  • Whether the non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, warrants bail
