Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner.

Summary

Muna Devi sought anticipatory bail fearing arrest in Siswan P.S. Case No. 213 of 2025, alleged to be involved in the dowry‑related death of an informant's daughter. The petitioner claimed innocence, asserting that the deceased had committed suicide as per independent witness statements, and highlighted her clean antecedent. The State opposed the bail, contending the offences under Sections 80 and 3(5) of the BNSS, 2023. The Court examined the facts, the petitioner’s background, and the credibility of the witnesses, and concluded that bail was appropriate. Consequently, the Court granted anticipatory bail subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS, with a bond of Rs.10,000 and two sureties.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC in view of the alleged dowry‑death offence.
  • Whether the allegations under Sections 80 and 3(5) of the BNSS, 2023, warrant denial of bail.
  • Whether the petitioner’s clean antecedent and the claim of suicide by the deceased justify the grant of bail.
