BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to prescribed conditions.

Summary

The petitioners, four residents of Naya Tola Mekra, sought anticipatory bail after being implicated in a FIR (Case No. 156 of 2025) for alleged looting of 16 quintals of wheat at gunpoint and assaulting an informant. The prosecution alleged offences under Sections 329(3), 115(2), 119(1), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, but no separate case under the Arms Act was filed. The petitioners contended that the case stemmed from a land dispute, they have clean antecedents, and a co‑accused had already been granted bail. The State opposed the anticipatory bail application. The High Court, applying Section 438(2) of the Code of Criminal Procedure and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, granted anticipatory bail with a Rs.10,000 bond and specific conditions, including regular appearance before the trial court and non‑interference with witnesses.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 438 CrPC and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
  • Whether the nature of the alleged offences and the absence of an Arms Act case justify denial of bail.
  • Whether the prior grant of bail to a co‑accused influences the decision on anticipatory bail.
