The court inclined to grant bail to the petitioner, subject to bond and conditions.
Summary
The petitioner, Agindeo Ram, was arrested in connection with a case involving arson and firing at three company vehicles, alleged under IPC sections 147, 148, 149, 307, 427, 436 and Arms Act section 27. The prosecution’s case is that unknown miscreants committed the offences, while the petitioner claims he was falsely implicated based on a co‑accused’s confessional statement and is not named in the FIR. He has been in custody since 29‑03‑2025 and possesses eleven prior criminal convictions. The petitioner’s counsel argued lack of specific allegations and the reliance on an omnibus charge, seeking bail. The State opposed bail, citing the seriousness of the offences and the petitioner’s antecedents. The court, after considering the circumstances and period of custody, granted bail subject to a bond of Rs.10,000 with two sureties and conditions regarding appearance in court.
Issues considered
- Whether bail should be granted to the petitioner despite the serious nature of the offences and his prior criminal record
- Whether the evidence, primarily a co‑accused’s confessional statement, is sufficient to justify continued detention
