Patna High Court

Vivek Sharma @ Vivekanand SharmaversusThe State of Bihar

Holding

The Court granted provisional anticipatory bail subject to bond, sureties and verification of antecedents.

Summary

The petitioner, Vivek Sharma, sought anticipatory bail after learning that he might be arrested in a case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged possession of 114.48 litres of liquor recovered from a motorcycle and a bag. He contended that he was not arrested at the spot, had no conscious possession, was not the owner of the vehicle or the bag, and that the prosecution’s case relied on a confessional statement made by another accused in police custody without any independent investigation. The State opposed the bail. The Court, applying Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS, granted provisional anticipatory bail subject to a bond of Rs 20,000 and two sureties, and directed verification of the petitioner’s criminal antecedents within six weeks. The order further provided that if more than four prior cases are found, the bail would not be confirmed; otherwise it would be confirmed.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 where the accused claims lack of conscious possession.
  • Whether a confessional statement of another accused, made in police custody, can form the basis for arrest without a proper investigation.
  • How the petitioner’s prior criminal antecedents affect the confirmation of anticipatory bail.

apprehended accused in police custody which does not have any

evidentiary value in the eye of law without holding a proper
