The Court granted provisional anticipatory bail to the petitioner, subject to conditions and verification of his criminal antecedents.

Summary

Arjun Kumar, the owner of a motorcycle from which 50 litres of liquor was seized, filed a petition for anticipatory bail under Section 30(a) of the Bihar Prohibition and Excise Act, claiming he had no knowledge of the liquor and was not in possession. He argued that he had a clean antecedent and that his friend, who fled the scene, misused the vehicle. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and a condition to deposit Rs.1500 with the Advocates’ Association. The trial court was directed to verify the petitioner’s criminal antecedents; if any antecedent is found, the bail would not be confirmed, otherwise it would be confirmed. The order was made under Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail for an alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the ownership of the vehicle used in the alleged offence can be a basis for granting bail.
  • Whether the petitioner’s alleged clean antecedent justifies provisional anticipatory bail.
