Guddu Kumar @ Abhishek KumarversusThe State of Bihar

The court granted provisional anticipatory bail, subject to a bond, sureties, a deposit, and verification of the petitioner’s antecedent cases.

Summary

The petitioner, Guddu Kumar, sought anticipatory bail after the police registered a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of over 3,200 litres of liquor from vehicles linked to him. He argued that he was not in possession of the seized liquor, did not own the vehicles, and was implicated solely on secret information without a proper investigation. The State opposed the bail, contending that the seriousness of the offence warranted his arrest. The High Court, considering the petitioner's lack of direct possession and the procedural deficiencies, granted provisional anticipatory bail conditioned on a bail bond of Rs 10,000 with two sureties and a deposit of Rs 5,000 with the Advocates’ Association. The order further directed the trial court to verify the petitioner’s criminal antecedents and to confirm the bail only if he has no more than two prior cases, otherwise the bail would not be confirmed.

Issues considered

  • Whether anticipatory bail can be granted in a case under the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the reliance on secret information without a proper investigation justifies denial of bail.
  • What conditions may be imposed on anticipatory bail, including verification of antecedent cases.
