Patna High Court

Prithwi Raj VermaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the conditions specified under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Prithwi Raj Verma, feared arrest in a criminal case filed under several IPC provisions (341, 323, 324, 498A, 504, 506, 34) and Section 4 of the Dowry Prohibition Act, alleging dowry‑related torture and cruelty. The prosecution alleged that the petitioner failed to meet dowry demands after his marriage to the informant in 2023. The petitioner argued that the dispute had already been settled through mediation at the Patna High Court’s Mediation and Conciliation Centre, with a settlement annexed to the record, and that he possessed a clean antecedent. The counsel for the second opposite party did not contest these submissions. Relying on the settlement, the clean record, and the lack of opposition, the Court granted anticipatory bail, directing that if arrested within eight weeks the petitioner be released on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the pending criminal charges and the settlement reached through mediation.
