Patna High Court

Shilpi DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The application for regular bail is allowed and the petitioner is released on bail.

Summary

The petitioner, Shilpi Devi, was arrested in connection with a case registered under sections 103(1), 333 and 61(2) of the B.N.S., 2023, alleging her involvement in the killing of a deceased person. She has been in custody since 31 May 2025. Counsel for the petitioner argued that the actual perpetrator was her husband and that she merely informed the deceased’s family about the death. The court noted the length of her detention and her status as a woman, and considered the merits of granting regular bail. Accordingly, the court allowed the bail application, directing that she be released on a bail bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur.

Issues considered

  • Whether regular bail should be granted to the petitioner in a case involving sections 103(1), 333 and 61(2) of the B.N.S., 2023
  • Whether the petitioner’s gender and period of custody warrant bail despite the seriousness of the alleged offence
