Patna High Court

Ravi Kishan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner subject to a bond and sureties.

Summary

The petitioner, Ravi Kishan Kumar, was arrested in connection with a kidnapping of a minor girl allegedly for the purpose of marriage, under Sections 96 and 3(5) of the BNS and a POCSO case (Case No. 38/25). He contended that he was falsely implicated, had a clean antecedent, and that the victim did not support the prosecution. The petition sought regular bail, arguing that he had been in custody since 26‑02‑2025 without substantive evidence. The Court examined the nature of the offences, the lack of victim cooperation, and the petitioner's personal background. It granted bail on condition of a Rs.10,000 bond with two sureties and required the petitioner to cooperate with the trial proceedings.

Issues considered

  • Whether regular bail can be granted to the accused in offences under Sections 96 and 3(5) of the BNS in a POCSO matter.
  • Whether the absence of victim support and the petitioner's clean antecedents justify bail.
