Patna High Court

Saddam HussainversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

The petitioner, Saddam Hussain, was arrested in connection with a case alleging that he, along with a co-accused, stabbed the son of an informant, causing injury. The prosecution cited offences under Sections 126(2), 115(2), 109, 352, 118(1) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. The petitioner’s counsel argued that he is innocent, the injury report does not corroborate the allegation, and he has no prior criminal record. The State opposed bail, citing the seriousness of the charges. After considering the submissions, the court granted bail on a cash bond of Rs. 10,000 with two sureties, imposing conditions such as regular court attendance, non‑tampering with evidence, and reporting any new similar charges. The bail order was issued by Justice Khatim Reza.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences alleged under the Bhartiya Nyaya Sanhita, 2023
  • Whether the lack of corroborative medical evidence and the petitioner’s clean record justify bail
