The court allowed the anticipatory bail application provisionally, subject to a bail bond, sureties, and verification of the petitioner’s antecedent.

Summary

Amit Kumar was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act for allegedly possessing two litres of liquor recovered from his motorcycle. He argued that he had a clean antecedent, was not in actual possession of the liquor, and that his brother had misused the vehicle without his knowledge. He applied for anticipatory bail, which the State opposed. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditions under Section 482(2) of the B.N.S.S., directing verification of his criminal antecedent. The order stipulated that if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed upon verification.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the circumstances of alleged possession of liquor.
  • Whether ownership of the vehicle implicates the petitioner in the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
  • Whether the conditions imposed under Section 482(2) of the B.N.S.S. are appropriate for provisional anticipatory bail.
