Holding
The court rejected the petitioner's pre‑arrest bail application.
Summary
Bablu Kumar applied for pre‑arrest bail in a case registered under several sections of the BNS, alleging serious offences. The court noted that the injuries inflicted were grievous and that there was a repeated assault on the informant's son. It also considered that a co‑accused, Niraj Kumar, had been denied bail due to a pending criminal antecedent. Given these circumstances, the judge was not inclined to extend bail to the petitioner. Consequently, the bail application was rejected.
Issues considered
- Whether the petitioner is entitled to pre‑arrest bail for offences under Sections 126(2), 115(2), 118(1), 109, 303(2) and 3(5) of the BNS in view of grievous injuries and repeated assault
