Anticipatory bail may be granted subject to conditions under Section 438(2) Cr.P.C. and Section 482(2) BNSS.

Summary

The petitioner, Babita Devi, sought anticipatory bail fearing arrest in a case registered under Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Act for alleged recovery of 36 litres of liquor from a motorcycle she owned. She argued that she had a clean antecedent, was not in conscious possession of the liquor, and was unaware that the vehicle was misused by another individual. The State opposed the grant of anticipatory bail. The Court examined the petitioner's lack of direct involvement, ownership of the vehicle, and her clean criminal record, and concluded that provisional anticipatory bail could be granted subject to bond and surety conditions. The order was made under Section 438(2) of the Criminal Procedure Code and Section 482(2) of the Bihar Narcotic Substances Act, with a directive that the trial court verify her antecedent before confirming the bail. If any prior case is discovered, the provisional bail may be withdrawn.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C. in view of the alleged offences under the Bihar Narcotic Substances Act and the Bihar Prohibition and Excise Act.

                                2. The petitioner apprehends her arrest in a case

petitioner was not arrested from the spot, as such, nothing was

recovered from her conscious possession. It is further submitted

that petitioner came to be implicated based on the fact that she is

owner of the seized vehicle. It is next submitted that no prudent

person would use her own vehicle for committing an occurrence

and thus would create evidence against herself and hence would

get implicated. It is also submitted that petitioner was

completely unaware that Vivek Kumar Yadav would misuse the

                       7. It is made clear that thereafter the learned trial

court shall verify the criminal antecedent of the petitioner and if

it is found that petitioner has antecedent of even one case, it

would be presumed that petitioner had concealed her antecedent
