Patna High Court

Md. AjamuddinversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner in the kidnapping case.

Summary

The petitioner, Md. Ajamuddin, was arrested in connection with a kidnapping case (PS Case No.194 of 2025) under Sections 137(2), 96 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, alleging he abducted a minor daughter of an informant for marriage. The petitioner argued that he was not named in the FIR and that the victim’s statement, recorded under Section 183 of the Bharatiya Nagrik Suraksha Sanhita, 2023, indicated she voluntarily went to his house after being refused by another man, with no allegation of sexual assault. The medical board report suggested the victim was actually 20‑22 years old, not a minor. The Additional Public Prosecutor opposed bail, but the court, after considering the facts and the victim’s statement, granted bail on condition of a Rs.10,000 bond with two sureties. The bail application was allowed.

Issues considered

  • What is the applicability of bail provisions in a kidnapping case under Sections 137(2), 96 and 3(5) of the Bharatiya Nyaya Sanhita, 2023?
  • Does the victim’s statement under Section 183 of the Bharatiya Nagrik Suraksha Sanhita, 2023, and the medical report indicating the victim is an adult, affect the grant of bail?
  • Whether the petitioner’s non‑naming in the FIR is a ground to deny bail?
