Manak RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

Manak Rai sought anticipatory bail fearing arrest in a case (PS No. 665 of 2025) involving alleged possession of 260 litres of liquor, alleged offences under Sections 30(a), 34, 36 and 30(c) of the Bihar Prohibition and Excise Act. He contended that he was falsely implicated, had no knowledge of the recovery which was from an open public place, and that no prima facie case existed; he also pointed out non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail. The Court, after considering the facts, ordered that the petitioner be released on anticipatory bail upon furnishing a bail bond of Rs.15,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023 in view of the alleged offences under the Bihar Prohibition and Excise Act.
