The court inclined to grant bail to the petitioner, subject to bond and conditions.
Summary
The petitioner, Laxmi Kamat, was arrested in connection with the recovery of 675 litres of liquor from a pickup van and charged under Section 30(a) of the Bihar Prohibition and Excise Act and Sections 274, 275 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. He contended that he was neither the owner nor the driver of the vehicle, that no incriminating material was found in his possession, and that his name was linked to the case through secret information. The petitioner, who has three prior criminal antecedents and has been in custody since 9 October 2025, argued that the prosecution had not complied with Section 103 of the BNSS. The State opposed bail. Considering the circumstances, the court granted bail, ordering a bond of Rs.15,000 with two sureties and imposing conditions regarding family surety and regular appearance in court.
Issues considered
- Whether bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita, 2023 in view of the alleged offences and his criminal antecedents.
- Whether the prosecution complied with the procedural requirements of Section 103 of the BNSS for bail consideration.
