Gaurav KumarversusThe State of Bihar

Holding

The court provisionally granted anticipatory bail with conditions, pending verification of the petitioner’s antecedent record.

Summary

The petitioner, Gaurav Kumar, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 7.250 litres of liquor from a scooter he owned. He argued that the liquor was not in his conscious possession and that he was unaware of his friend's misuse of the vehicle. The petitioner, who has two prior excise cases, sought anticipatory bail, while the State opposed the relief. The High Court granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties and deposit Rs.2,500 with the Lawyers’ Association, subject to verification of his criminal antecedents. The court stipulated that if more than two prior cases are discovered, the provisional bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • What is the applicability of anticipatory bail under Section 482(2) of the BNSS in a case where the accused is the owner of the vehicle from which liquor was seized?
  • Whether the petitioner’s prior two excise cases preclude the grant of anticipatory bail?

                                2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                                3. Learned counsel for the petitioner submits that

petitioner was not apprehended from the spot as such nothing

was recovered from his conscious possession and he came to be

implicated based on the fact that he is owner of the seized

vehicle. It is next submitted that no prudent person would use

his own vehicle for committing an occurrence and thus would

it is further submitted that petitioner was completely unaware

that his friend would misuse the vehicle in the manner as

                       5. Learned A.P.P. for the State opposes the prayer for

                       7. It is made clear that thereafter the learned Trial

Court shall verify the criminal antecedent of the petitioner and

in the event if it is found that petitioner has antecedent of more

than two cases then it would be presumed that petitioner, for the

purposes of seeking anticipatory bail, had concealed his
