The Court granted provisional anticipatory bail subject to bail bond, sureties, a deposit with the Legal Services Committee, and verification of the petitioner’s criminal antecedent.
Summary
The petitioner, Sanjay Chaudhary, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of liquor from his house and related premises. He contended that he was not arrested on the spot, that the liquor was stored in a joint family property, and that the amended Act had abolished the concepts of deemed possession and presumed offender. The State opposed the bail, arguing the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.15,000 with two sureties and a deposit of Rs.7,500 with the High Court Legal Services Committee, subject to verification of the petitioner’s criminal antecedent. The order further stipulated that if the petitioner is found to have more than three prior cases, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail should be granted under Section 438 Cr.P.C. in a case of alleged possession of liquor under the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the amendment removing the concepts of deemed possession and presumed offender affects the bail application.
- Whether the petitioner’s prior criminal antecedent (three cases) influences the grant of anticipatory bail.
