Patna High Court

Ravi Ranjan Kumar @ Raushan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail must be granted to the petitioner.

Summary

The petitioner, Ravi Ranjan Kumar, was arrested in connection with the alleged recovery of 82 litres of liquor from a premises belonging to Dashrath Bhuiyan, under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018/2022. He contended that the liquor was not found in his possession, that the recovery was made from a location not owned by him, and that the case was based solely on secret information without a proper investigation. The State opposed bail, citing his antecedent case under the Excise Act. The Court examined the lack of direct possession, the nature of the evidence, and the principle that bail may be granted when the prosecution’s case is weak or investigatory lapses exist. Accordingly, the Court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of equal amount, pending further trial.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018/2022 despite an antecedent case.
  • Whether the recovery of liquor from a premises not owned by the petitioner and the reliance on secret information justify denial of bail.
