The High Court held that anticipatory bail may be granted under Section 482(2) of the BNSS even for serious IPC offences, subject to appropriate conditions.

Summary

The petitioner, Raunak Mandal, sought anticipatory bail after being implicated in a complaint (Case No. 38 of 2023) alleging multiple offences under the Indian Penal Code, including assault, robbery, and sexual offences. The prosecution alleged that the petitioner purchased the complainant for Rs. 50,000 and forced intercourse, while the petitioner claimed innocence, stating the dispute stemmed from a marital conflict between the complainant and her husband. The State opposed the bail application, arguing the seriousness of the charges. The Court examined whether anticipatory bail could be granted under Section 482(2) of the BNSS despite the gravity of the alleged offences. Considering the facts and the principle of liberty, the Court allowed the anticipatory bail with specified conditions. The order directed the petitioner to furnish bail bonds of Rs.10,000 each with two sureties upon arrest or surrender within four weeks.

Issues considered

  • Whether anticipatory bail can be granted in a case involving multiple serious offences under the IPC.
  • Whether Section 482(2) of the BNSS empowers the High Court to grant anticipatory bail in such circumstances.
