Patna High Court

Bicky KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner.

Summary

The petitioner, Bicky Kumar, sought anticipatory bail after learning that he might be arrested in a robbery case under Section 392 of the Indian Penal Code. The FIR described an assault and theft of jewellery, a mobile phone and cash by three unknown persons, but the petitioner’s name does not appear in the FIR; he was implicated solely on the basis of a confessional statement made by co‑accused Vinod Kumar. No stolen property was found in the petitioner’s possession and he has a clean antecedent. The State opposed the bail application. Considering the lack of direct evidence, the petitioner’s clean record and the nature of the accusation, the Court granted anticipatory bail, directing the petitioner to surrender within eight weeks and to furnish a bail bond of Rs 10,000 with two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted to a person not named in the FIR but implicated solely on a co‑accused’s confessional statement under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
