Holding

The Court granted provisional anticipatory bail to the petitioner, subject to verification of his antecedents and compliance with the conditions under Section 482(2) of the CrPC.

Summary

The petitioner, Bhola Kumar Sah, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016‑22 (Amended) concerning alleged recovery of 10,200 litres of liquor from a sack placed on a public street adjacent to his shop. He argued that he was not arrested on the spot, no liquor was found in his possession, and the police relied on secret information without proper investigation. The State opposed the bail, contending the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.25,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedents. If more than five prior cases are found, the bail would be presumed concealed and not confirmed; if exactly five, the bail would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances.
  • Whether the conditions imposed under Section 482(2) of the Code of Criminal Procedure are appropriate.
  • Whether the petitioner’s prior criminal antecedents affect the grant of bail.

based on secret information which is the easiest way to

implicate someone. It is next submitted that once an accused is
