The Court granted provisional anticipatory bail subject to bond, sureties, and verification of antecedents.

Summary

The petitioner, Dablu Kumar, sought anticipatory bail fearing arrest in a case under the Bihar Prohibition and Excise Act for alleged possession of 1,093.01 litres of liquor recovered from a room in a shop run by his brother. He argued that he was not arrested at the scene, no liquor was found in his immediate possession, and the premises were a joint family property, making it uncertain that he had knowledge or control over the liquor. The State opposed the bail, citing the seriousness of the offence and the petitioner’s prior eight cases under the Excise Act. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.40,000 with two sureties and directed the trial court to verify the petitioner’s criminal antecedents. If more than eight prior cases are found, the bail may be revoked; otherwise, it will be confirmed.

Issues considered

                   A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

registered for the offence punishable under Sections 30(a), 32(3)

and 62 of Bihar Prohibition and Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of eight cases under the Excise Act and

allegation is of recovery of 1093.01 litres of liquor from a room

situated at south side of the shop run by Shankar Kumar. It is

next submitted that petitioner was not arrested from the spot as

such nothing was recovered from his conscious possession and

he came to be implicated based on the fact that he is brother of

Shankar. It is also submitted that the house in question is a joint

be alleged with certainty that it was petitioner, who had kept the

liquor in the room or the liquor kept in the room was within his

knowledge. It is next submitted that once an accused is

implicated in a case relating to excise, the police starts

implicating mechanically and in the instant case the petitioner

came to be implicated based on secret information which is the

          easiest way to implicate someone.

                       4. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                       5. Considering the submissions made by the learned

counsel for the petitioner, the petitioner above-named, in the

event of his arrest or surrender before the learned Court below

within a period of six weeks from today, be released on

provisional anticipatory bail on furnishing bail bonds of

Rs.40,000/- (Rupees forty thousand) with two sureties of the

conditions as laid down under Section 482(2) of the B.N.S.S.

                       6. It is made clear that the learned trial court thereafter

had concealed his antecedent before this court, as such, the
