Patna High Court

Kanhaiya Rai @ Kanhaiya YadavversusThe State of Bihar

DISPOSED

Holding

The Court granted provisional anticipatory bail with conditions, subject to verification of the petitioner’s antecedents.

Summary

The petitioner, Kanhaiya Rai, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, where 400 litres of spirit were allegedly recovered from a location adjacent to his house. He argued that the police had mechanically implicated him without proper investigation and that no contraband was found in his possession. The State opposed the bail. The High Court granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties and that the trial court verify his criminal antecedents. If the verification shows more than two prior cases, the bail would not be confirmed; if exactly two, the bail would be confirmed. The order was made under Section 482(2) of the Code of Criminal Procedure.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in the excise case.
  • Whether the conditions imposed, including verification of prior antecedents, are appropriate under law.
