Ramji ManjhiversusThe State of Bihar

Holding

The court held that provisional anticipatory bail may be granted subject to verification of the petitioner’s antecedent and compliance with conditions under Section 482(2) of the BNSS.

Summary

The petitioner, Ramji Manjhi, sought anticipatory bail in a case registered under Section 30(a) of the Bihar Excise Act for alleged recovery of 50 litres of liquor from his house. He argued that he has a clean antecedent, that the liquor was not found in his conscious possession, and that the 2018 amendment to the Excise Act abolished the concept of deemed possession and presumed offender. The court noted that the house is joint family property, making it uncertain whether the petitioner had knowledge of the liquor. The State opposed the bail, but the court granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and verification of the petitioner’s antecedent by the trial court. The order stipulated that if any prior case is discovered, the bail would be revoked, otherwise it would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Excise Act where possession is not established.
  • Whether the 2018 amendment to the Bihar Excise Act eliminates the doctrine of deemed possession and presumed offender.
  • Whether the petitioner’s clean criminal antecedent justifies the grant of anticipatory bail.
