Patna High Court

Trideep RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioners subject to bond and conditions.

Summary

The petitioners, Trideep Ram and Ranjeet Kumar, were arrested after 315 litres of liquor were recovered from a car in Ratanpur. They contended that they were merely passengers, not owners of the vehicle, and that no incriminating article was found on them, asserting false implication. The prosecution charged them under Section 30(a) of the Bihar Prohibition and Excise Act, while the petitioners highlighted the lack of compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The State opposed the bail application. Considering the absence of direct evidence, the period of custody already served, and the petitioners’ limited involvement, the court granted bail subject to bond and conditions. The order released the petitioners on bail with specified sureties and compliance requirements.

Issues considered

  • Whether bail should be granted to the petitioners under Section 30(a) of the Bihar Prohibition and Excise Act
  • Whether non‑compliance with Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, precludes bail
  • Whether the petitioners’ status as passengers without ownership of the vehicle negates criminal liability
