Bail is granted to the petitioner subject to a Rs.10,000 bond, two close‑relative sureties, and weekly police‑station attendance.
Summary
The petitioner, Sonu Kumar, was arrested in connection with a theft of jewellery worth Rs.15,00,000 and cash of Rs.20,000 from the informant’s brother’s house, alleged under sections 331(4) and 305 of the Bihar Negotiable Securities Act, 2023. He had been in custody since 22 July 2025 and filed a bail application before the Patna High Court. The court examined the nature of the offence, the period of detention, and the petitioner’s ties to the community. Considering the length of custody and the circumstances, the court allowed bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties who are close relatives. Additional conditions required the petitioner to report to the Mansoorchak Police Station every Sunday, with non‑compliance leading to cancellation of bail. The order was pronounced by Justice Sandeep Kumar.
Issues considered
- Whether bail should be granted to the petitioner for offences under sections 331(4) and 305 of the Bihar Negotiable Securities Act, 2023 given the nature of the theft and the period of custody.
